viziers Posted June 3, 2006 Posted June 3, 2006 OK so the thing of it is i have read on multiple sites that it is highly illegal to make/produce such things as cherries, m"s which is perfectly fine i have absolutely no interest in them.. But most sites do not say it is illegal to make fireworks aerials is it legal or not if it is legal what is needed to pursue the hobby?? P.S. if this needs to be worded differently please let me know. This post is not intended to cause trouble of any kind i'm just looking for guidence not flamming or slandering... As for what is needed to pursue the hobby, I don't think that they would list that as they probably don't have it themselves. I believe that you need an ATF liscence, a proper magazine to store everything, registartion with the local poice department, and the bomb squad on speed dial.
Mumbles Posted June 3, 2006 Posted June 3, 2006 Well, laws willl vary by country. If you want to get technical, the ATF can only control storage, not manufacture. The "manufacturer licence" is just to store manufactured devices. Also it lets you test said devices on your own property. If you make the device and don't store it, technically it's not illegal. Well, as long as it isn't banned by the CSPC, such as M-80's, bulk salutes, and the like. This has to be taken with a grain of salt though, as they will always claim you were storing it. They will call it a "destructive device" and then ream you in the ass. If you want to be completely legal, you will need about 40 acres, be 21, a magazine, ATF licence, some other stuff.

No problem mumbles, the reason i asked about the legality to make an aerial shell is because as in other posts my GF sayes its illegal to make as well as have i don't know if this is the right word to use but to have explosive/volitile chemicals on residential property we own 1 1/4 acres in residential hood but however if it is indeed legal with the normal and obvious safty precautions then hey thats great because i have 20 or so 1 3/4 shells and a few 3" shells comming and as the website sayes absolutely NON-REFUNDABLE....
Kilo_G Posted June 3, 2006 Posted June 3, 2006 Ok, I'm going to explain this. To be legal on a FEDERAL level you don't need any licensing at all. The orange book/whatever BATFE's current rules/laws are only apply to people IN COMMERCE (aka you sell what you make and or charge money for displays). For the most part the only BATFE rules/laws that apply to the hobbyist are storage and storage distances (very important to read up on). Now, that being said, every state is different and it is very important that you check your state laws to see what they have to say about pyrotechnics manufacture and storage.

The US government doesn't care, but if California has a law banning all fireworks other than sparklers because of fire hazard, then if your caught setting off a shell in California you're screwed. Check your state and county laws ( only applicable to the US as far as I know )

Lets just say i live north of SC and east of TN...

You'd be fine with 3" shells or whatnot Thanks Mumbles, The one good thing is i live 13 miles outside of the city limits "more cow/corn fields than people and lots of open areas but the developement i live in has about 100 houses all on their own 1 1/4 acres or more per house which is good because theres approx 100 to 300 yards from back or front of the houses to the next house but only about 30 to 50 ft on the sides of houses if that all makes sense. viziers

If I was to make anything, the only thing I can do is probably sneak out at night, light it in a field in the back of a junior high, and run. Practically, I'm screwed when it comes to this stuff. Does anyone have any ideas of when I can do stuff, or what I would need to watch out for? (Note- I live in Naperville, a suburb of Chicago)Thanks,Mark
aquaman Posted June 7, 2006 Posted June 7, 2006 Its hard to find a perminate spot to just do stuff for hours so what your doing is probably going to be the best you can do unless you have a friend or relative that owns a couple of acres. The few steps I use when doing things: Try doing things in open fields away from houses (less houses= less cop calls). Second like you said light, watch, and run. Don't stick around too long as the cops are probably on the way. Keep everyone watching far enough away (if anybody's watching). And the last thing I can think of is carry water and a shovel. If a fire starts because of dry grass or something you need to have something to put it out. Use the water for small fires and shovel for any fires (if any) after you used the water. That's what I do but jugde what you can do.
